1. Agreement to These Terms
By purchasing, enrolling in, accessing, or participating in this family online education course (the “Course”), you agree to these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not purchase, access, or use the Course.
If a child or other minor participates in the Course, the parent or legal guardian accepts these Terms on behalf of that minor and agrees to be fully responsible for that minor’s participation, supervision, and safety.
In these Terms, “Instructor,” “Provider,” “Course Provider,” “I,” “me,” and “my” refer to the person or brand offering the Course.
2. Course Description
The Course provides educational content, guidance, and activities for families, including observation-based learning, indoor activities, and outdoor observation activities.
The Course is designed primarily for families with children approximately ages 5–12. However, these Terms apply to any child or minor who participates in the Course, whether or not they fall within that typical age range.
Outdoor observation activities are a central part of this Course and are strongly encouraged as part of the learning experience, but parents and guardians are always the final decision-makers about whether, when, and how to perform them with their children.
The Course is offered for educational and informational purposes only. It is not medical advice, mental health advice, legal advice, emergency guidance, or certified safety training.
3. Parent and Guardian Responsibility
A parent or legal guardian must supervise all participating minors at all times. Children and minors must not perform Course activities alone.
Parents and guardians remain fully responsible for deciding when, where, and how to carry out any activity in the Course, especially outdoor activities, with their children.
You are solely responsible for deciding whether any activity is appropriate for your child based on age, maturity, judgment, skills, health, mobility, attention, and the environment in which the activity takes place.
You agree to modify, relocate, postpone, or skip any activity that you believe is unsafe, unsuitable, or inappropriate for your family.
4. Outdoor Activities and Safety
Outdoor observation and exploration are a core, strongly encouraged part of this Course. Many lessons and activities are designed with outdoor environments in mind.
Any outdoor activity described in the Course is a suggestion only. The Course Provider does not supervise, monitor, control, inspect, or guarantee the safety of any location where you choose to perform Course activities. You are solely responsible for selecting a safe place, time, route, and conditions for participation.
Parents and guardians are fully responsible for supervising minors during all activities, especially in areas involving traffic, water, wildlife, insects, plants, uneven ground, steep surfaces, weather exposure, tools, public spaces, or interactions with other people.
You agree to use reasonable caution and to follow all applicable laws, traffic rules, park rules, property rules, posted warnings, and common-sense safety practices.
You are also responsible for ensuring appropriate clothing, footwear, hydration, weather protection, sun protection, and any other safety precautions your family may need.
If any outdoor activity seems unsafe or inappropriate in your circumstances (for example, due to weather, location, health, or your child’s abilities), you agree to adjust or skip that activity and choose an alternative that better fits your situation.
5. Assumption of Risk
Outdoor and physical activities involve inherent risks. These risks may include, without limitation, slips, trips, and falls; collisions; exposure to traffic; uneven or slippery surfaces; weather-related conditions; insect bites and stings; contact with animals or plants; allergic reactions; interactions with other people; and other known and unknown risks.
By participating in the Course and engaging in its outdoor activities, you understand and acknowledge that these activities involve inherent risks.
You, as parent or legal guardian, remain fully responsible for deciding when, where, and how to carry out any outdoor activity with your child, and for modifying, relocating, or skipping any activity that does not feel safe or suitable for your family.
By participating in the Course and choosing to engage in its outdoor activities, you knowingly and voluntarily assume all risks associated with those activities for yourself and for any minor under your supervision.
6. Release and Waiver of Liability
To the fullest extent permitted by applicable law, you agree that the Instructor or Course Provider is not responsible for any injury, illness, death, property damage, financial loss, personal loss, or other loss arising out of or related to your participation in the Course or any related activity, including its core outdoor observation activities.
This release applies to, without limitation, claims arising from your choice of location and timing, environmental conditions, acts or omissions of third parties, acts of nature, and decisions made by you or your family before, during, or after participation. The Course Provider does not supervise, monitor, or control your environment and cannot ensure or guarantee safety in any place you choose to use the activities.
You, on behalf of yourself and any participating minor, hereby release, waive, and discharge the Instructor or Course Provider from any and all claims, demands, causes of action, damages, liabilities, costs, and expenses arising from or related to participation in the Course and its activities, including outdoor activities, except where such a waiver is not permitted under applicable law.
You understand that this release is a material condition of accessing the Course and that the Course Provider would not offer the Course without this allocation of risk and responsibility.
7. No Guarantee of Safety or Results
The Course cannot guarantee safety, outcomes, or results. Activity suggestions are general in nature and may not be suitable for every child, family, location, season, or circumstance.
Your family’s experience and outcomes depend on many factors beyond the Course Provider’s control, including your choices, environment, and your child’s needs.
You remain fully responsible for using your own judgment and for making all safety decisions for yourself and any participating minors.
8. Health and Emergency Disclaimer
The Course does not provide medical care, diagnosis, treatment, therapy, crisis response, or emergency services.
If you or your child has any health condition, allergy, physical limitation, developmental concern, or other issue that could affect safe participation, you should consult an appropriate qualified professional before participating in any activity.
In an emergency, contact local emergency services immediately.
9. User Conduct
You agree not to use the Course in any unlawful, harmful, abusive, or unsafe manner.
You agree not to encourage minors to act beyond their abilities, ignore safety precautions, enter unsafe areas, trespass, or violate local rules or laws.
You agree to use the Course in a way that respects other people, property, and the environment.
To the fullest extent permitted by law, the Course Provider will not be liable for any claim, loss, or damage arising out of or relating to user‑generated content, comments, or interactions on or through the Site.
10. Intellectual Property
All Course materials, including text, lessons, worksheets, videos, graphics, downloads, and related content, are owned by or licensed to the Course Provider and are protected by applicable intellectual property laws.
Course materials are for personal, household, non-commercial use only. You may not copy, reproduce, distribute, republish, sell, share outside your household, or create derivative works from the Course materials without prior written permission.
11. Payments and Refunds
Any pricing, payment terms, subscription terms, installment terms, refund policy, or cancellation policy presented at the time of purchase are incorporated into these Terms.
By enrolling, you agree to the payment and refund terms shown on the purchase page.
Unless a separate written refund policy clearly states otherwise, all sales are final.
12. Limitation of Liability
To the fullest extent permitted by law, any liability arising out of or relating to the Course will be limited to the amount you actually paid for the Course.
To the fullest extent permitted by law, the Instructor or Course Provider will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of use, loss of data, loss of goodwill, or loss of opportunity.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you; in that case, they apply only to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless the Instructor or Course Provider from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- Your use or misuse of the Course.
- Your violation of these Terms or of any applicable law or rule.
- Your failure to supervise a minor or to provide a safe environment.
- Your participation in any Course activity, including outdoor activities.
14. Privacy and Children
If you provide personal information in connection with the Course, you represent that you have the right to provide it.
If a child participates in the Course, the parent or legal guardian is responsible for monitoring that child’s use of the Course and for providing any permissions or consents required by applicable law.
A separate Privacy Policy may also apply and will describe how personal information is collected, used, and stored.
15. Suspension or Termination
The Course Provider may suspend or terminate access to the Course at any time if:
- These Terms are violated.
- Payment is not completed or is reversed.
- Continued participation appears to create risk, misuse, or harm.
- The Course is discontinued for business or operational reasons.
Upon suspension or termination, you must stop using the Course and its materials, except for any rights that must be preserved under applicable law.
16. Changes to These Terms
These Terms may be updated from time to time. The “Last updated” date at the top will change when updates are made.
Continued use of the Course after updated Terms are posted constitutes acceptance of the revised Terms.
17. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, unless applicable law requires otherwise.
Any dispute arising out of or relating to these Terms or the Course shall be resolved in the appropriate courts located in Texas, unless applicable law requires a different forum.
